DUALITY POLE DANCING STUDIO – WAIVER, TERMS AND CONDITIONS
This document constitutes a legally binding agreement between you (the “Client”) and Duality Pole Dancing Studio (“Duality”, “we”, “us” or “the Studio”). By enrolling in, attending, or participating in any class, workshop, private lesson, casual session or practice time, or by entering the premises, you acknowledge that you have read, understood and agree to be bound by all terms set out below. No participation is permitted without acceptance of this agreement.
00. RIGHT TO UPDATE TERMS
Duality reserves the absolute right, at its sole discretion, to amend, vary, update or replace these Terms and Conditions at any time without prior notice. Any such amendments take effect immediately upon publication or communication. Continued attendance or participation constitutes acceptance of the updated Terms.
01. BOOKINGS, ENROLMENT & FINANCIAL LIABILITY
By enrolling in any class, course, workshop, private lesson, casual booking or purchasing any class pass, you enter into a binding financial agreement. Once an invoice has been issued or booking confirmed, no cancellations, withdrawals or reductions are permitted except where expressly stated. You remain fully liable for all fees regardless of attendance, non-attendance or any change in circumstances.
Clients are expected to book classes with the genuine intention of attending and to manage their bookings responsibly.
02. REFUNDS, TRANSFERS & CREDITS
Duality operates a strict no refund policy except where required by law.
Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law or any other applicable law. Where required, remedies will be provided in accordance with those laws.
Transfers and credits are governed by booking type.
For season enrolments, transfers between classes or to another individual are permitted only within the same season, subject to availability and level suitability, and must be completed prior to Sunday of Week 1.
For casual classes and class passes, bookings are non-transferable. Credits are only issued where cancellation occurs within the permitted window.
For workshops, all bookings are strictly non-refundable and non-transferable.
For private lessons, a minimum of twenty-four (24) hours’ notice is required for cancellation or rescheduling. Failure to provide the required notice will result in the full fee being charged with no exceptions.
03. PAYMENTS & DEPOSITS
For season enrolments, a non-refundable deposit equal to fifty percent (50%) of the total course fee is required within forty-eight (48) hours of booking. The remaining balance must be paid by Sunday of Week 1. Failure to pay does not cancel your enrolment, and you remain liable for the full amount.
Withdrawal prior to season start results in forfeiture of the deposit. Withdrawal after Week 1 results in full fee liability.
For workshops, full payment is required within twenty-four (24) hours.
For casual classes and class passes, full payment is required at booking.
04. ATTENDANCE, CANCELLATIONS, NO-SHOWS & CLASS CREDITS
All bookings, including season classes, casual classes and class passes, are subject to the following conditions.
Where a Client cancels more than four (4) hours prior to class start, the session will be returned as a credit or catch-up class and must be used within the same season.
Where a Client cancels less than four (4) hours prior, the session is forfeited with no credit. No additional fee applies.
Where a Client fails to attend and has not cancelled prior to class start, this constitutes a no-show.
In the event of a no-show, the session is forfeited and a $20 AUD no-show fee will be applied. This applies to all Clients, including season enrolments.
No-show fees must be paid before future bookings. Duality reserves the right to suspend or restrict booking access and to recover any unpaid fees as a debt.
Where a Client is denied entry under Section 05 and has not cancelled prior to class start, this will be treated as a no-show.
All determinations are based on system-recorded timestamps, including booking and access logs.
05. ATTENDANCE, STUDIO ACCESS, LATE POLICY & LOCKOUT
All classes commence strictly at their scheduled start time. Clients must arrive prior to class commencement to participate in the full warm-up.
Studio doors unlock fifteen (15) minutes prior to class and remain unlocked until one (1) minute after class start.
Access outside this window is managed via the Kisi system. Clients are responsible for setup and access. Failure to access Kisi does not excuse lateness.
A Client arriving later than four (4) minutes, fifty-nine (59) seconds and fifty-nine (59) milliseconds after class start will not be permitted entry under any circumstances.
From five (5) minutes after class start, no access is available. No staff member will open doors, respond to doorbells, phone calls or entry requests, or grant access manually. No exceptions apply.
Clients arriving beyond this threshold are deemed no-shows and subject to forfeiture and applicable fees.
Duality maintains access logs, including Kisi timestamps, which may be used to enforce this policy.
06. MAKE-UP (CATCH-UP) CLASSES
Catch-ups require marking absence at least four (4) hours prior. Catch-ups are not guaranteed, must be used within the same season, and are forfeited if unused or missed.
07. TIMETABLE, STAFFING & STUDIO OPERATIONS
Duality may change schedules, instructors or formats at any time. Where Duality cancels a class, a credit or refund may be issued at its discretion.
Where Duality is required to cease or restrict operations due to government legislation, public health orders or circumstances beyond its control, the season will be paused and will resume once permitted. No refunds will be issued in these circumstances.
Where a Client is unable to attend due to government-imposed restrictions, Duality may, at its discretion, provide limited credits or catch-up opportunities, subject to verification.
08. HEALTH, MEDICAL FITNESS & ILLNESS
You confirm you are medically fit to participate and responsible for obtaining clearance where required.
Clients must disclose all relevant injuries, illnesses or conditions to their instructor prior to class participation which may affect their participation.
Duality may refuse participation where safety is a concern.
09. INJURY, RISK & LIABILITY WAIVER
Risk Warning (Civil Liability Act 2002 NSW):
Participation in recreational activities involves significant inherent risks, including the risk of personal injury or death. You acknowledge these risks are obvious and voluntarily assume them.
You agree that Duality will not be liable for injury, loss or damage arising from the materialisation of an obvious risk associated with recreational activities.
To the fullest extent permitted by law, you release Duality from all liability, including negligence, arising from participation.
10. CONDUCT & STUDIO BEHAVIOUR
Clients must follow all instructor directions and behave respectfully and safely.
Disruptive, unsafe or inappropriate behaviour is prohibited, including refusal to follow instruction, misuse of equipment, or behaviour that risks safety.
Clients must not engage in harassment, bullying, discrimination or intimidation. Duality maintains a zero-tolerance policy.
Clients must not teach or instruct others.
Attendance under the influence of drugs or alcohol is prohibited.
Mobile phone use is limited to filming yourself. Messaging or calls during class are not permitted. Filming others requires consent.
Duality may refuse entry or remove any Client immediately, without refund or credit, where behaviour is unsafe, disruptive or inconsistent with the Studio environment. Serious or repeated breaches may result in permanent exclusion.
11. SAFETY IN PRACTICE
Only authorised instructors may teach movements. Clients must not instruct others. Breaches result in removal.
12. CLEANLINESS & STUDIO USE
Clients must maintain hygiene and clean equipment before and after use.
13. DAMAGES & PERSONAL BELONGINGS
Clients are liable for damage caused. Duality is not responsible for lost or stolen items.
14. INTELLECTUAL PROPERTY
All Duality materials remain its property. Reproduction or teaching without permission is prohibited and will result in removal and permanent ban.
15. AGE REQUIREMENT
All participants must be 18 years or older.
16. COMMUNICABLE ILLNESS
You accept the risk of illness exposure and agree not to attend when unwell.
17. REFERRAL PROGRAM
Referral credits are non-transferable, non-refundable and must be used within the stated timeframe.
18. SEVERABILITY
If any provision is invalid, the remainder remains enforceable.

By participating, you confirm that you have read, understood and agree to be legally bound by these Terms.
